What are the qualifying conditions to get an Arkansas Medical Marijuana Card?

To receive a medical cannabis card in Arkansas, a patient must qualify. That simple means person seeking to obtain their mmj card, must have one of the following conditions:

  • Cancer
  • Glaucoma
  • Severe arthritis
  • Fibromyalgia
  • Alzheimer’s disease
  • Cachexia or wasting syndrome
  • Peripheral Neuropathy
  • Hepatitis C
  • Amyotrophic lateral sclerosis
  • Tourette’s syndrome
  • Crohn’s disease
  • Ulcerative colitis
  • Post-traumatic stress disorder
  • Severe nausea
  • Intractable pain which is pain that has not responded to ordinary medications, treatment or surgical measures for more than six (6) months
  • Seizures including without limitation those characteristic of epilepsy
  • Severe and persistent muscle spasms including without limitation those characteristic of multiple sclerosis and any other medical condition or its treatment approved by the Department of Health
  • Positive status for human immunodeficiency virus/ acquired immune deficiency syndrome

Another requirement to qualify for a medical cannabis card is to be aged eighteen or older. However, minors with qualifying conditions can apply for medical marijuana cards with parental consent. The parent will be the designated caregiver and can purchase medical marijuana products on behalf of the patient at dispensaries. Minors cannot purchase products from a medical marijuana dispensary, without their legal caregiver.

To qualify as a designated medical marijuana card caregiver:

  • Must be 21 years of age or older
  • The individual you are providing care for must be physically disabled or a minor
  • The potential caregiver must be an Arkansas Resident
  • Not be a member of the AR National Guard and United States Military

A designated caregiver can be issued a medical marijuana registry card that allows him/her to possess up to 2.5 ounces of medical cannabis on behalf of their patient. It is not legal for caregivers to consume the medical marijuana that was dispensed to the patient. If a caregiver is not the parent or legal guardian of the patient, she/he will pay for a criminal background check (including fingerprints) in addition to the application fee to the state, and the fee for the doctor card certification.

According to the state of Arkansas regulations, members of the National Guard and U.S. Military cannot receive medical marijuana cards. Arkansas Healthy states, “Legislation passed in 2017 prohibits members of Arkansas National Guard and United States military from obtaining a qualified patient or designated caregiver registry ID card.”

Legally, medical marijuana cannot be prescribed to patients because it is not FDA approved. However, patients can be “recommended” to use medical cannabis – this recommendation is what patients receive from AR MMJ Cards’ medical marijuana doctors. It is a document that is certified by an OD or MD stating that a patient qualifies for medical cannabis based on a qualifying condition. The Physician Certification for medical marijuana is valid for 30 days. If a patient fails to submit the certification within that time frame, a new certificate must be obtained. To begin the process for physician certification for medical marijuana, you need complete the New patient application if you are a first time card holder, or Renewing patient application, if you are renewing your medical card. Once you’ve completed your application, it will be reviewed by our qualified patient care staff. If you qualify, you’ll receive a notification of your pre-qualification and be added to the schedule to see one of our Telemedicine doctors via video or voice call.

Once a medical cannabis patient has completed Steps One through Four above, a patient or caregiver can apply to the state for approval and receive an Arkansas Medical Marijuana card, which can be used at dispensaries across Arkansas.

  • Apply online or by mail for a medical marijuana card
    • Online applications are preferred for medical cannabis cards and can be completed by going to this link: https://www.healthy.arkansas.gov/programs-services/topics/id-card-apply-online.
    • A state issued ID, physician certification (only the ADH form), and payment of fees will be required to complete the application process. For patient and caregiver applications, the fee is $50. If the caregiver must submit a background check (link to Step 2 above), another $37 fee is charged.
    • A patient or caregiver will create an account and then complete the application and pay fees through AMM.
    • To email a question about an application, patients can send an email to adh.medicalmarijuana@arkansas.gov.
    • Medical Cannabis Card applications may take 10 to 14 days to process and incomplete applications will be returned.
    • Medical Marijuana Cards in Arkansas are valid for 1 year and must be renewed annually.
  • As stated on their site, the Arkansas Department of Health, is the issuing agency and will not provide information to patients about medical marijuana doctors, legal matters, personal matters or decisions, or info about other states’ programs.
